1. Criminal proceedings cannot be accepted if:

1) the requirements of the second part of Article 598 of this Code or an international treaty of the Republic of Kazakhstan have not been complied with;

2) a court has acquitted the same person in connection with the same crime in the Republic of Kazakhstan.;

3) in relation to the same person, in connection with the same crime in the Republic of Kazakhstan, a court has passed a guilty verdict, according to which the sentence has already been served or is being executed.;

4) criminal proceedings have been terminated against the same person in connection with the same crime in the Republic of Kazakhstan or he has been released from serving his sentence due to a pardon or amnesty;

5) proceedings in respect of the crime in question may not be carried out due to the expiration of the statute of limitations.

2. If the Prosecutor General's Office of the Republic of Kazakhstan refuses to continue criminal prosecution, it returns the materials to the central authority of the foreign state with the justification for the refusal.
