Article 679. Obligations of the contractor (executor) of the Civil Code of the Republic of Kazakhstan
1. The contractor (executor) under a contract for scientific research or development and technological work is obliged to:
1) perform the work in accordance with the program (technical and economic parameters) or subject agreed with the customer and transfer the result to the customer within the time period stipulated by the contract;
2) comply with the requirements related to the legal protection of intellectual property;
3) eliminate, on their own and at their own expense, deficiencies in the technical documentation caused by their fault, which may lead to deviations from the technical and economic parameters provided for in the customer's terms of reference or in the contract.;
4) immediately inform the customer about the discovered inability to obtain the expected results or the inexpediency of continuing work;
5) to guarantee to the customer that third parties do not have exclusive rights to the results transferred on the basis of such an agreement.
2. Unless otherwise provided by contracts for research or development and technological work, the contractor (contractor) is obliged to:
1) refrain from publishing scientific and technical results obtained during the performance of work without the consent of the customer;
2) take measures to protect the results obtained during the performance of work capable of legal protection and inform the customer about it;
3) grant the customer an exclusive license to use legally protected scientific and technical results applied in the completed works.
