Article 74. Civil defendant of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. A natural or legal person who is sued in a criminal case is recognized as a civil defendant.

     2. A civil defendant, in order to protect his interests in connection with a claim brought against him, has the right:

     1) to know the essence of suspicion, accusation and civil action;

     2) to object to the claim, to file a counterclaim;

     3) provide explanations and testimony on the merits of the claim;

     4) have a representative;

     5) submit materials for inclusion in the criminal case;

     6) to file petitions and challenges;

     6-1) express consent to the application of writ proceedings in the case of a criminal offense or a minor offense;

     7) upon completion of the investigation, get acquainted with the materials related to the civil claim and write out any information and in any volume, with the exception of information constituting state secrets.;

     8) to know about the decisions taken affecting his interests and to receive copies of the procedural decisions related to the filed civil claim;

     9) participate in the consideration of a civil claim in any court instance;

     10) to speak in court debates, to bring complaints about actions (inaction) and decisions of the body conducting the criminal process;

     11) to get acquainted with the minutes of the court session and submit comments on it;

     12) appeal the verdict and court decisions regarding the civil claim;

     13) to know about the protests brought in the case, the prosecutor's petitions and complaints regarding the civil claim and to file objections to them;

     14) participate in the judicial review of the filed complaints, prosecutor's petitions and protests;

     15) declare the adoption of security measures.

     3. The civil defendant shall bear the obligations stipulated in the eighth part of Article 71 of this Code.

     4. A civil defendant also has other rights and other duties provided for by law.
