Article 836. Replacement of the policyholder of the Civil Code of the Republic of Kazakhstan
1. In the event of the death of the policyholder who has concluded a property insurance contract, the rights and obligations of the policyholder shall pass to the person who has inherited this property. In other cases of transfer of ownership (or other proprietary rights), the rights and obligations of the policyholder are transferred to the new owner (or holder of other proprietary rights) with the consent of the insurer, unless otherwise provided by the contract or legislative acts.
2. In the event of the death of the policyholder who has concluded a personal insurance contract in favor of the insured, the rights and obligations determined by this contract shall pass to the insured with his consent. If it is impossible for the insured to fulfill his obligations under the insurance contract, his rights and obligations may be transferred to persons who, in accordance with legislative acts, carry out duties to protect his rights and legitimate interests.
3. In case of reorganization of the policyholder, who is a legal entity, during the period of validity of the insurance contract, his rights and obligations under this contract shall be transferred with the consent of the insurer to the appropriate legal successor in accordance with the procedure established by this Code.
