Comment to article 413. Termination of proceedings on private charges The Criminal Procedure Code of the Republic of Kazakhstan

Private prosecution proceedings are subject to termination in the presence of the circumstances provided for in Article 35 of this Code, as well as in connection with the death of a private prosecutor, except in cases where close relatives of the victim or the defendant insist on hearing the case.

The procedure for terminating proceedings on a private charge is determined by the general rules of this Code, taking into account the specifics provided for in this chapter.

 

In the presence of the circumstances provided for in Article 35 of this Code, as well as in connection with the death of a private prosecutor, the criminal case of a private prosecution is subject to termination. The proceedings in the case are not subject to termination if the close relatives of the private prosecutor or the defendant insist on considering the case.

The judge issues a reasoned decision on the termination of proceedings in a private prosecution case. The termination procedure is determined by the general rules of the criminal procedure law, taking into account the specifics provided for in this chapter.
