Commentary to article 649. Termination of a case in a jury trial The Criminal Procedure Code of the Republic of Kazakhstan
The presiding judge shall terminate the case at any stage of its trial by a court with the participation of jurors if, during the trial, the circumstances provided for in part one of Article 35 of this Code are clarified, as well as if the public prosecutor refuses to charge in accordance with part seven of Article 337 of this Code.
After the release of the jurors from participation in the trial, the presiding judge alone issues an appropriate decision on the case.
The law allows for the termination of a criminal case during its consideration by a court with the participation of jurors.
When terminating a criminal case during a trial involving jurors, the requirements provided for in article 35 and part 7 of Article 337 of the CPC regarding the procedure for terminating criminal cases on certain grounds must be strictly observed.
