     1. To ratify the Amendment to the Agreement between the Republic of Kazakhstan and the United States of America on the Destruction of Silo Launchers of Intercontinental Ballistic Missiles, Elimination of Consequences of Emergency Situations and Prevention of Proliferation of Nuclear Weapons, signed in Washington on December 13, 2007.        2. This Law has retroactive effect in relation to legal relations that have arisen since December 13, 1993.

Amendment to the Agreement between the Republic of Kazakhstan and the United States of America concerning the Destruction of Silo Launchers of Intercontinental Ballistic Missiles, Elimination of Consequences of Emergency Situations and Prevention of Proliferation of Nuclear Weapons  

     The Republic of Kazakhstan and the United States of America, hereinafter referred to as the Parties, agree as follows:  

      In accordance with Article XIV of the Agreement between the Republic of Kazakhstan and the United States of America on the Destruction of Silo Launchers of Intercontinental Ballistic Missiles, Emergency Response and Prevention of Nuclear Proliferation, signed on December 13, 1993, which was continued on December 5, 2000 (hereinafter referred to as the Agreement), the Parties agree to extend the validity of the Agreement and to introduce The following changes have been made to it:  

      1. In the title of the Agreement, replace the words "nuclear weapons" with the words "weapons of mass destruction"; 2. In the third paragraph of the preamble and in paragraph b) of article I, the words "nuclear weapons from the Republic of Kazakhstan" should be replaced by the words "weapons of mass destruction, including nuclear, biological, chemical and radiological"; 3. In the first paragraph of article I, replace the words "nuclear weapons and the prevention of the proliferation of nuclear weapons, including:" with the words "and the prevention of the proliferation of weapons of mass destruction and related materials, technologies and knowledge, including but not limited to:"; 4. In paragraph (e) of article I, the words "destruction of strategic offensive weapons located in the Republic of Kazakhstan" should be replaced by the words "prevention of the proliferation of weapons of mass destruction and related materials, technologies and knowledge"; 5. Paragraph 1 of Article XII should be supplemented with the sentence "The procedure for such exemption is determined by the Government of the Republic of Kazakhstan."; and 6. Article XIV shall be worded as follows: "This Agreement shall enter into force from the date of its signature and shall remain in force for 7 years. It is automatically extended for subsequent seven-year periods, unless either Party notifies the other Party in writing of its intention not to extend its validity no later than 6 months before the expiration of the corresponding seven-year period. This Agreement will terminate three months after receiving such notification. This Agreement may be amended by written agreement of the Parties. Regardless of the termination of this Agreement or executive agreements, the obligations of the Republic of Kazakhstan in accordance with articles VI and VII of this Agreement shall remain in force regardless of the time frame, unless the Parties agree otherwise.".  

     This Amendment shall apply provisionally from the date of signature, shall enter into force on the date of receipt by the Government of the United States of America of a written notification from the Government of the Republic of Kazakhstan on the completion of the internal procedures necessary for its entry into force, and shall apply from the date of entry into force of the Agreement.  

     IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Amendment.  

     DONE in the city of Washington ________ _________ 2007 year in two copies, each in Kazakh and English. In case of disagreement in the interpretation of the provisions between the Kazakh and English texts, the English text will prevail.
