The decision to assign the responsibility for the liquidation of a legal entity to a specific person
There are cases when the courts, having decided to liquidate an absent legal entity, do not indicate in the judicial act, in accordance with the explanations of paragraph 20 of Regulatory Decree No. 5, a specific person who is responsible for conducting liquidation procedures.
So, in the civil case on the claim of the State Revenue Agency for the Mugalzharsky district of the Department of State Revenue for the Aktobe region on the liquidation of LLP "Zh", the court, having satisfied the claim, did not decide to assign the obligation to liquidate it to a specific person, thereby violating the requirements of Article 50 of the Civil Code.
