Appeals and requests from individuals and legal entities, as well as a Lawyer and Legal consultant
In accordance with the Law of the Republic of Kazakhstan On the Procedure for Considering Appeals from Individuals and Legal Entities related to the submission and consideration of appeals from individuals and legal entities in order to exercise and protect their rights, freedoms and legitimate interests, every citizen, legal entity, Lawyer and Legal Consultant have the right to request information both orally and in writing, including in the form of an electronic document, to a government agency or to its official about providing information that is not classified, confidential, or official secret. A request is a request from a person to provide information on matters of a personal or public nature. Requests during press conferences, videoconferences, interviews, and phone calls are equivalent to an oral request. One of the most effective ways to obtain the necessary information from authorities and institutions is to contact them with written requests.
The Law provides for liability for failure to provide the requested information, thus impeding the legitimate activities of a Lawyer or Legal Consultant in accordance with article 668 of the Code of Administrative Offences of the Republic of Kazakhstan and article 435 of the Criminal Code of the Republic of Kazakhstan entails liability established by the legislation of the Republic of Kazakhstan. And also, in accordance with article 189 of the Code of the Republic of Kazakhstan on Administrative Offenses, liability is provided for violating the procedure and deadlines for considering appeals from individuals and legal entities in the form of an administrative fine. For violation of legislation at the request or request of an individual and a legal entity, the action and or omission of an authorized person or body may be appealed to the head of a higher authority, a supervisory authority, or to a court.
