Article 14-2. Notification procedure for changing and supplementing registration and other information of a Legal entity, branch (representative Office) of the Law on State Registration of Legal Entities and Registration of Branches and Representative Offices
Changes and additions to the registration data of a legal entity, branch (representative office) are made when:
1) changes in the location of a legal entity related to the subject of a private enterprise, branch (representative office), with the exception of a joint-stock company, branch (representative office);
2) changes in the head (appointment of the head, appointment of the acting head, appointment of the manager of the property and activities of the legal entity, dismissal of the head);
3) making amendments and additions to the constituent documents, with the exception of the requirements provided for in Articles 14-1 of this Law;
4) transfer of a share of the authorized capital to the trust management;
5) increase in the authorized capital of business partnerships;
6) changes and (or) additions to types of economic activity;
7) changes in the composition of the founders (precinct officers, members) of non-profit organizations, with the exception of political parties.
8) changes in the beneficial owner of the legal entity.
9) changes in contact information (phone number, e-mail address).";
In Part two, replace the words "7) and 8)" with the words "7), 8) and 9)"
Changes and additions to the registration data of a legal entity, branch (representative office) specified in the sub-paragraphs 1), 2), 4), 5), 6), 7) and 8) the first part of this article, introduced automatically on the basis of electronic control.
Changes and additions to the registration data of a legal entity, branch (representative office), specified in subparagraph 3) of part one of this article, are made on the basis of an electronic message with the attachment of the documents provided for in these articles.
The change of the location of a legal entity belonging to the subject of a private enterprise, branch (representative office), with the exception of a joint-stock company, branch (representative office), is carried out with the consent of the owner of immovable property through the mediation of an electronic digital subscription.
The exception is cases of changing the names of settlements and streets in accordance with the requirements of the Constitutional Law of the Republic of Kazakhstan "On the Administrative-Territorial Structure of the Republic of Kazakhstan".
Late notification to the registering authority of a change in the location of a legal entity includes administrative liability in accordance with the Code of the Republic of Kazakhstan on Administrative Offenses.
When changing the composition of the founders (precinct members) of non-profit organizations, a list of the founders (precinct members) of the non-profit organization is additionally provided, indicating the surname, first name, patronymic (if it is indicated in the identity document), date, month, year of birth, individual identification number, place of residence, contact phone number, personal subscription.
Legal entities, branches (representative offices) shall notify the registering authority of amendments and additions to the constituent documents specified in part one of this Article, with the exception of subparagraph 5), within one month from the date of the decision to make amendments and additions to the constituent documents.
Changes and additions to the registration and other information of a legal entity, branch (representative office) are recorded within three working days from the date of submission of the electronic notification.
10. The existence of judicial acts, orders (prohibitions, arrests) of bailiffs and law enforcement agencies, as well as the cases provided for in paragraphs 3), 4), 4-1), 5) and 8) of the first part of Article 11 of this Law, are grounds for leaving an electronic message without execution with notification of the conspirator.
A legal entity or a branch (representative office) is responsible for the completeness and accuracy of the entered information.
