Article 107. Jurisdiction over the communication of cases and the choice of the parties Administrative Procedural Procedure Code of the Republic of Kazakhstan
1. A claim against several defendants may be filed at the location of one of the defendants. The choice between several courts, which, according to this article, have jurisdiction over the case, belongs to the plaintiff.
The plaintiff may choose extraterritorial jurisdiction, including in administrative cases pending before the court, before the appointment of an administrative case for trial at a court hearing, with the exception of cases to be considered in accordance with part three of Article 102, Article 103, part one of Article 105, parts two and three of Article 106 and Chapter 25 of this Code. The Code.
2. The parties may, by agreement between themselves, change the territorial jurisdiction for this administrative case, including for administrative cases pending before the court, prior to the appointment of the administrative case for trial at a court hearing.
3. The claim for damages caused by the defendant, involving an administrative act, administrative action (inaction), is considered by a specialized district and equivalent administrative court.
4. A claim for compensation for moral damage is considered in civil proceedings.
5. Several claims may be combined by the plaintiff in one claim if they are brought against one defendant, are interconnected and their consideration falls within the competence of one court.
6. It is not allowed to combine into one proceeding several claims that are subject to consideration in different types of legal proceedings, unless otherwise established by this Code. At the same time, claims that are not related to public law disputes and are subject to separation should be singled out and sent by jurisdiction to the appropriate district (city) court.
