Comments on article 28. Jurisdiction of civil cases to the Supreme Court of the Republic of Kazakhstan of the Civil Procedure Code of the Republic of Kazakhstan
The Supreme Court of the Republic of Kazakhstan considers and resolves civil cases according to the rules of the court of first instance:1) on challenging decisions and actions (inaction) of the Central Election Commission of the Republic of Kazakhstan, decisions and actions (inaction) of the Central Referendum Commission; 2) on investment disputes in which a major investor is a party.Civil cases on challenging decisions and actions (inaction) of the Central Election Commission, decisions and actions (inaction) of the Central Commission of the Referendum are considered and resolved by the Supreme Court according to the rules of the court of first instance in accordance with the provisions provided for in Chapter 27 of the CPC in the order of special claim proceedings (see comment).The procedure, terms and procedure for consideration and appeal are regulated in detail by the said chapter.If investment disputes involving investors are considered by a specialized court of the city of Astana, then the same cases involving a major investor are considered by the Supreme Court according to the rules of the court of first instance.A large investor is an individual and legal entity that invests in the Republic of Kazakhstan in the amount of at least two million times the monthly calculation index.
