Article 122. Sexual intercourse or other sexual acts with a person who is obviously under the age of sixteen, as well as receiving prostitution or other sexual services provided by a known minor of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1. Sexual intercourse, sodomy, lesbianism or other sexual acts with a person who is obviously under the age of sixteen, –

are punishable by restriction of liberty for a term of up to five years or by imprisonment for the same term with life imprisonment for the right to hold certain positions or engage in certain activities.

2. Receiving prostitution or other sexual services provided by a known minor, –

is punishable by imprisonment for a term of three to six years with life imprisonment for the right to hold certain positions or engage in certain activities.

3. The acts provided for in the first part of this Article committed against a person under the age of sixteen by a parent, stepfather, stepmother, teacher or other person who is charged by the law of the Republic of Kazakhstan with the duties of his upbringing, –

are punishable by imprisonment for a term of seven to twelve years with life imprisonment for the right to hold certain positions or engage in certain activities.

4. The acts provided for in the first, second or third parts of this Article, committed:

1) repeatedly;

2) in relation to two or more persons, –

are punishable by imprisonment for a term of twelve to fifteen years with life imprisonment for the right to hold certain positions or engage in certain activities.

Note. In this Article and Articles 134, 308 and 309 of this Code, other sexual services are understood to mean performing actions aimed at satisfying another person's sexual needs (passions), including remotely in real time via telecommunications networks, including the Internet, in order to obtain income or property benefits.
