1. The classification of plant species into the category of rare and endangered plant species is carried out on the basis of inventory data and scientific research conducted within the boundaries of the natural range of these species, and the conclusion of the interdepartmental botanical commission.

2. The protection of rare and endangered plant species is carried out by:

1) identification of areas of their growth, study, preservation in botanical collections and collections of plant genetic resources;

2) establishment of a special protection regime in their growing areas;

3) creation and expansion of specially protected natural territories;

4) ensuring their preservation by the owners and users of the plots on which these plants grow, in accordance with the legislation of the Republic of Kazakhstan.

3. The withdrawal of rare and endangered plant species, their parts or derivatives is carried out on the basis of a decision of the Government of the Republic of Kazakhstan for:

1) breeding in specially created conditions for the purpose of:

restoration of natural populations;

International exchange (international trade);

2) scientific research, including the creation of collections, genetic banks of plants;

3) breeding.

The provisions of this paragraph do not apply to rare and endangered plant species planted and growing as part of green spaces in populated areas, with the exception of urban forests.

4. Protection of endemic and relict plants is carried out in accordance with the provisions of Article 12 of this Law.

The Law of the Republic of Kazakhstan dated January 2, 2023 No. 183-VII SAM.

This Law regulates public relations and establishes the legal basis of state policy in the field of protection, restoration, and use of flora.
