Article 181. Employee's rights and obligations in the field of occupational safety and health of the Labor Code of the Republic of Kazakhstan

Article 181. Employee's rights and obligations in the field of occupational safety and health of the Labor Code of the Republic of Kazakhstan  

     1. An employee has the right to:

     1) a workplace equipped in accordance with occupational safety and health requirements;

     2) provision of sanitary facilities, means of individual and collective protection in accordance with the requirements of occupational safety and health, as well as labor and collective agreements;

     3) contacting a territorial subdivision about conducting a survey of working conditions and safety at his workplace;

     4) participation in person or through his representative in the review and consideration of issues related to the improvement of working conditions, safety and health;

     5) refusal to perform work in the event that the employer does not provide the employee with means of individual and (or) collective protection and in the event of a situation that poses a threat to his health or life, with written notification to his immediate supervisor or employer.;

     6) education and professional training necessary for the safe performance of work duties, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     7) obtaining reliable information from the employer about the characteristics of the workplace and the territory of the organization, the state of conditions, safety and labor protection, the existing occupational risk, as well as measures to protect it from the effects of harmful and (or) dangerous industrial factors;

     8) maintaining wages for the duration of the suspension of the organization's work due to non-compliance with occupational safety and health requirements.

     2. The employee is obliged to:

     1) comply with the requirements of norms, rules and instructions on occupational safety and health;

     2) immediately inform the employer or the work organizer about every work injury and other damage to the health of employees, signs of occupational disease (poisoning), as well as about a situation that poses a threat to human life and health;

     3) undergo mandatory preliminary and periodic medical examinations, as well as pre-shift and other medical examinations in accordance with the procedure determined by the authorized body in the field of healthcare;

      4) at the request of the employer, undergo preventive medical examinations in cases stipulated by the employer's act, as well as when transferring to another job.;  

     5) inform the employer about the establishment of disability or other deterioration of health that prevents the continuation of work duties;

     6) strictly apply and use for their intended purpose the means of individual and collective protection provided by the employer;

     7) comply with the requirements of the state labor inspector, the technical inspector for labor protection, internal control specialists, and medical and recreational measures prescribed by medical institutions;

     8) undergo training, instruction and verification of knowledge on occupational safety and health in accordance with the procedure determined by the employer and provided for by the legislation of the Republic of Kazakhstan.
