Article 279. Guarantees of investors' rights during nationalization and requisition of the Entrepreneurial Code of the Republic of Kazakhstan  

     1. The forced seizure of an investor's property (nationalization, requisition) for state needs is allowed in exceptional cases provided for by the laws of the Republic of Kazakhstan.

     2. Upon nationalization, the investor is fully compensated by the Republic of Kazakhstan for the losses caused to him as a result of the issuance of legislative acts of the Republic of Kazakhstan on nationalization.

     3. The investor's property is requisitioned with the payment of the market value of the property.

     The market value of the property is determined in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     4. The valuation according to which the value of the requisitioned property was reimbursed to the owner may be challenged by him in court.

     5. Upon termination of the circumstances in connection with which the requisition was made, the investor has the right to demand the return of the remaining property, but at the same time is obliged to return the amount of compensation received by him, taking into account losses from a decrease in the value of the property.
