Article 276. Guarantee of legal protection of investors' activities in the territory of the Republic of Kazakhstan of the Entrepreneurial Code of the Republic of Kazakhstan  

     1. The investor is provided with full and unconditional protection of rights and interests, which is provided by the Constitution of the Republic of Kazakhstan, this Code and other regulatory legal acts of the Republic of Kazakhstan, as well as international treaties ratified by the Republic of Kazakhstan.

     2. The investor has the right to compensation for damage caused to him as a result of the issuance by state bodies of acts that do not comply with the laws of the Republic of Kazakhstan, as well as illegal actions (inaction) of officials of these bodies, in accordance with the civil legislation of the Republic of Kazakhstan.

     3. The Republic of Kazakhstan guarantees the stability of the terms of agreements concluded between investors and government agencies of the Republic of Kazakhstan, except in cases when amendments to the agreements are made by agreement of the parties.

     These guarantees do not apply to:

     1) changes in the legislation of the Republic of Kazakhstan and (or) entry into force and (or) amendments to international treaties of the Republic of Kazakhstan, which change the procedure and conditions for the import, production, sale of excisable goods;

     2) amendments and additions that are made to the laws of the Republic of Kazakhstan in order to ensure national security, public order, public health and morals.

4. Decisions of state bodies and local executive bodies on conducting inspections in respect of investors included in the register of investors are made after their mandatory coordination with the prosecutor.

     The approval procedure is determined by the Prosecutor General of the Republic of Kazakhstan.
