Article 35. Legal capacity of a legal entity of the Civil Code of the Republic of Kazakhstan
1. A legal entity may have civil rights and bear duties related to its activities in accordance with this Code. Commercial organizations, with the exception of State-owned enterprises, may have civil rights and bear civil duties necessary to carry out any types of activities that are not prohibited by legislative acts or constituent documents.
In cases stipulated by legislative acts, the opportunity to engage in other activities may be excluded or limited for legal entities engaged in certain types of activities.
A legal entity may engage in certain types of activities, the list of which is determined by legislative acts, only on the basis of a license.
2. The legal capacity of a legal entity arises at the time of its creation and ceases at the time of its liquidation. The legal capacity of a legal entity in the field of activity for which a permit is required arises from the moment such a permit is obtained and is terminated at the time of its withdrawal, expiration or invalidation in accordance with the procedure established by legislative acts of the Republic of Kazakhstan.
3. The legal capacity of a legal entity that is a non-profit organization and is maintained only at the expense of the state budget (state institution) is determined by this Code and other legislative acts of the Republic of Kazakhstan.
