Article 1095. Legal capacity and legal capacity of an individual of the Civil Code of the Republic of Kazakhstan
1. The civil legal capacity of an individual is determined by his personal law. At the same time, foreign citizens and stateless persons in the Republic of Kazakhstan enjoy civil legal capacity on an equal basis with citizens of the Republic of Kazakhstan, except in cases established by legislative acts of the Republic of Kazakhstan or international treaties ratified by the Republic of Kazakhstan.
2. The legal capacity of an individual is determined by his personal law.
3. The civil legal capacity of an individual in relation to transactions and obligations arising from causing harm is determined by the law of the country of the place of transactions or obligations arising from causing harm.
4. The ability of an individual to be an individual entrepreneur and have related rights and obligations is determined by the law of the country where the individual is registered as an individual entrepreneur. In the absence of the country of registration, the law of the country of the main place of individual business activity is applied.
5. The recognition of an individual as legally incompetent or with limited legal capacity is subject to the law of the country of the court.
