Article 361. Prevention of deterioration of water, air and soil pollution of the Environmental Code of the Republic of Kazakhstan
1. When handling mining waste, it is mandatory to comply with the environmental requirements established by this Code to prevent water pollution by:
1) assessment of the potential of filtrate formation, including pollutants contained in the filtrate, of stored waste during operation and after closure of the waste storage facility, determination of the water balance of the waste storage facility;
2) preventing or minimizing the formation of filtrate and contamination of surface or groundwater and soil;
3) collection and purification of polluted water and filtrate to the level necessary for their discharge.
2. The operator of a waste storage facility is required to take measures to prevent or reduce dust and gas emissions.
3. When placing mining waste back into open-pit or underground mine workings that are susceptible to flooding, the operator of the waste storage facility must take the necessary measures to prevent or minimize deterioration of water and soil conditions.
4. If cyanide is present in the storage pond, the operator must ensure that the cyanide concentration in the liquid waste is reduced to the lowest possible level using the best available techniques.
