Article 143. Identification, assessment and accounting of objects of historical pollution of the Environmental Code of the Republic of Kazakhstan

1. The identification of objects of historical pollution is carried out through an inventory and survey of territories and water areas where anthropogenic activities were carried out in the past and (or) where ownerless capital construction facilities and (or) ownerless waste storage or disposal facilities are located.

2. The rules for the identification, assessment and accounting of objects of historical pollution, including the maintenance of the state register of objects of historical pollution, are approved by the authorized body in the field of environmental protection, taking into account the requirements of this Code (hereinafter – the rules for the identification, assessment and accounting of objects of historical pollution).

3. Local executive authorities of districts and cities organize the identification and assessment of objects of historical pollution. By decision of the Government of the Republic of Kazakhstan, the identification and assessment of individual objects of historical pollution is organized by the authorized body in the field of environmental protection.

To carry out work on the identification and assessment of objects of historical pollution, the state bodies specified in part one of this paragraph shall involve organizations licensed to perform work and provide services in the field of environmental protection, in accordance with the legislation of the Republic of Kazakhstan on public procurement.

4. The assessment of an object of historical pollution includes the establishment of:

1) volume or mass of pollutants, waste by their types;

2) the area of territories and water areas or their sections on which the object of historical pollution is located, the categories and types of lands and waters allowed for use;

3) the level and volume of negative impact on the environment, including the ability of pollutants to migrate to other components of the natural environment, the possibility of contamination of water bodies, including those that are sources of drinking water supply, the possibility of new environmental damage and harm to human life and (or) health;

4) the presence at the facility of historical contamination of hazardous substances specified in international treaties to which the Republic of Kazakhstan is a party;

5) the number of people living in the territory, the environment in which is adversely affected by the object of historical pollution;

6) the number of the population living in the territory, the environment in which is under threat of negative impact from the object of accumulated environmental damage.

5. Historical pollution objects are recorded by including them in the state register of historical pollution objects within a period not exceeding thirty working days from the date of receipt by the authorized body in the field of environmental protection from the state bodies specified in paragraph 3 of this article of the results of the identification and assessment of historical pollution objects.

The State Register of Objects of Historical Pollution is an electronic data bank that collects information about identified objects of historical pollution, including information on the results of the assessment of objects of historical pollution in accordance with paragraph 4 of this Article, their origin, ownership of objects of historical pollution and the necessary work to eliminate historical pollution.

The maintenance of the state register of objects of historical pollution at the expense of budgetary funds is organized by the authorized body in the field of environmental protection.

6. The maintenance of the state register of objects of historical pollution includes:

1) review of materials for the identification and assessment of objects of historical pollution;

2) making a decision on inclusion or refusal of inclusion in the state register of objects of historical pollution;

3) categorization of objects of historical pollution;

4) updating information about the historical pollution site;

5) exclusion from the state register of objects of historical pollution.

7. The categorization of objects of historical pollution is carried out in relation to objects of historical pollution included in the state register of objects of historical pollution.

The categorization of objects of historical pollution is carried out by comparing their impact on environmental safety in order to justify the priority and priority of work to eliminate historical pollution, as well as other urgent measures.

Based on the results of categorization of objects of historical pollution by the authorized body in the field of environmental protection, priority objects are determined for which work on the elimination of historical pollution, as well as the adoption of other urgent measures, should be carried out as a matter of priority, and the order of work on the elimination of other objects of historical pollution included in the state register of objects of historical pollution..

8. The State Register of objects of historical pollution is publicly available on the Internet resource of the authorized body in the field of environmental protection.
