Article 38. Agreements on pension provision at the expense of mandatory pension contributions, mandatory professional pension contributions of the depositor (recipient) with the unified accumulative pension fund and conditional pension accounts of the Social Code of the Republic of Kazakhstan

1. Agreements on pension provision through mandatory pension contributions, mandatory occupational pension contributions, which establish the rights, duties, responsibilities and other legal relationships of the unified accumulative pension fund and depositors of mandatory pension contributions, individuals for whom mandatory occupational pension contributions are listed (recipients of pension payments), are accession agreements, are being developed by the unified accumulative pension fund on the basis of this Code, They are approved by an internal document of the unified accumulative pension fund and posted on the Internet resource of the unified accumulative pension fund.

2. The opening of an individual pension account in the unified accumulative pension fund to account for mandatory pension contributions and mandatory occupational pension contributions is carried out on the basis of lists of individuals submitted by agents to the unified accumulative pension fund when transferring mandatory pension contributions, mandatory occupational pension contributions or penalties in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

At the same time, information about citizenship, status, legal capacity, details of a valid identity document, registration at the place of residence in the Republic of Kazakhstan, the telephone number of a cellular subscriber device registered on the e-government web portal, and other information about an individual, if any, necessary for the implementation of the functions of a single accumulative pension fund. The unified accumulative pension fund receives funds provided for by the legislation of the Republic of Kazakhstan from the relevant information systems of state bodies.

The contributor of mandatory pension contributions, the agent, and the individual for whom mandatory occupational pension contributions are transferred are considered to have joined the pension insurance agreement at the expense of mandatory pension contributions, mandatory occupational pension contributions from the date of crediting mandatory pension contributions, mandatory occupational pension contributions, or penalties to an open individual pension account to account for mandatory pension contributions, mandatory occupational pension contributions The contributor of mandatory pension contributions, the agent, and the individual for whom mandatory occupational pension contributions are transferred are considered to have joined the pension insurance agreement at the expense of mandatory pension contributions, mandatory occupational pension contributions from the date of crediting mandatory pension contributions, mandatory occupational pension contributions, or penalties to an open individual pension account to account for mandatory pension contributions, mandatory occupational pension contributions. At the same time, the consent of the legal representative of the minor is not required to join the pension insurance agreement due to mandatory pension contributions.

3. If an individual has an open individual pension account in the unified accumulative pension fund to account for mandatory occupational pension contributions, the individual pension account intended for accounting for mandatory occupational pension contributions cannot be reopened.

At the same time, an agent who has paid mandatory occupational pension contributions in favor of an individual is considered to have joined the pension provision agreement at the expense of mandatory occupational pension contributions from the date of crediting mandatory occupational pension contributions or penalties to a previously opened individual pension account to account for mandatory occupational pension contributions.

4. Conditional pension accounts are opened in the unified accumulative pension fund to account for the employer's mandatory pension contributions based on the list of individuals submitted by the agent to the unified accumulative pension fund when transferring the employer's mandatory pension contributions in accordance with the procedure established by the internal rules of the unified accumulative pension fund.
