Article 443. Evasion or refusal from military service of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1. Evasion by a serviceman from performing his duties of military service by feigning illness or causing himself any injury (self-mutilation) or other harm to his health, or forgery of documents, or other deception, as well as refusal to perform military service –

     are punishable by a fine in the amount of up to two hundred monthly calculation indices, or correctional labor in the same amount, or arrest for up to fifty days.

     2. The same acts committed in a combat situation or a state of emergency, or during wartime, –

     are punishable by imprisonment for a term of ten to twenty years or by life imprisonment.

     3. Excluded by the Law of the Republic of Kazakhstan dated 07/16/2025 No. 210-VIII (effective sixty calendar days after the date of its first official publication).
