Article 49-2. Evading community service The Code of the Republic of Kazakhstan on Administrative Offences
A person who evades performing public works is recognized as:
1) who failed to appear at the summons of the local executive body to execute a court order on the appointment of public works without valid reasons;
2) who refused to start performing community service;
3) who has failed to appear at the organization more than twice during the period of performing public works without valid reasons;
4) arrived to perform public works, appeared and (or) is in a state of alcoholic, narcotic or substance intoxication during the performance of public works, confirmed by a medical examination in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
5) who has left the Republic of Kazakhstan without valid reasons.
Note. Valid reasons for the offender's failure to perform community service at the appointed time are illness and other documented circumstances that deprive the offender of the opportunity to arrive on time to perform community service.
