Article 48. Calculation of terms of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The time limits established by this Code shall be calculated in hours, days, months, and years.
2. When calculating deadlines, the hour and the day on which the deadline begins are not taken into account. This rule does not apply to the calculation of time limits for detention, detention, house arrest, and being in a medical facility or educational institution with a special regime of detention.
3. When calculating the time limit, non-working hours are also included.
4. The term calculated in days expires at twenty-four hours of the last day of the term. The term calculated in months expires on the corresponding month and date of the last month of the term. If the deadline falls on a month that does not have a corresponding date, the deadline expires on the last day of that month. The term, calculated in years, expires on the corresponding month and date of the last year of the term. If the deadline falls on a month that does not have a corresponding date, the deadline expires on the last day of that month. In cases where the last day of the term falls on a non-working day, the day of the end of the term is considered to be the next working day, except in cases of calculating the time limits for detention, detention, house arrest and being in a medical institution or educational organization with a special regime of detention.
5. When a person is detained on suspicion of committing a criminal offense, the time limit is calculated from the moment (an hour to the minute) of the actual application of this measure. When calculating the terms of detention, house arrest, as well as being in a medical institution or educational organization with a special regime of detention, the first day of the term is included in the term.
