Article 54-1. Execution of the resolution of the territorial body of justice formed in the state automated digital system of enforcement proceedings The Law on Payments and Payment Systems

     1. A resolution of the territorial body of justice, formed in the state automated digital system of enforcement proceedings, certified by means of an electronic digital signature of the head of the territorial body of justice or his deputy, requesting information on bank account numbers and the availability of money in them, information on the nature and value of property held in banks, organizations engaged in certain types of banking operations, and also in insurance organizations, and the seizure of them is presented to banks, organizations, performing certain types of banking operations through the state automated digital system of enforcement proceedings.

     2. A bank or an organization engaged in certain types of banking operations, on the basis of the document specified in paragraph 1 of this Article, shall, within three business days from the date of receipt of the said document, send the necessary information to the state automated digital system of enforcement proceedings in accordance with the requirements of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan".

     3. The territorial body of justice, having received the specified information from banks and organizations engaged in certain types of banking operations, sends a collection order with the attachment of the enforcement document through the state automated digital enforcement system to the bank, organization engaged in certain types of banking operations.

     This Law regulates public relations arising in the field of organization and functioning of payment systems, regulation of payment systems and supervision (oversight) of them, regulation of the payment services market and control over it, as well as the implementation of payments and (or) money transfers in the Republic of Kazakhstan.
