Article 16. Rights and obligations of the parties to enforcement proceedings The Law on Enforcement Proceedings and the Status of Bailiffs
1. The parties to the enforcement proceedings have the right to get acquainted with the materials of the enforcement proceedings, including in electronic form, make extracts from them, make copies, submit additional materials, file petitions, participate in the execution of enforcement actions, give oral and written explanations in the process of enforcement actions, express their arguments and considerations on all issues arising in the case. in the course of enforcement proceedings, to object to the arguments and petitions of other persons participating in the enforcement proceedings, to file challenges, appeal against the actions (inaction) or decisions of the bailiff on enforcement proceedings, apply to the court with an application for approval of the settlement agreement.
2. The parties to the enforcement proceedings are obliged to exercise in good faith all the rights granted to them, as well as comply with the requirements of this Law.
The debtor is obliged to inform the bailiff in writing within three working days about changes in his place of work, place of residence and location, as well as about the emergence of new sources of income and property from the moment of the occurrence of these circumstances.
The debtor is obliged to appear to the bailiff once a month before the end of the enforcement proceedings, as well as in cases of summons. Failure to appear entails liability in accordance with the laws of the Republic of Kazakhstan.
