Article 54. Arrival of the cargo at the address of the improper recipient of the Railway Transport Act
1. In case of arrival at the address of the recipient of the cargo, the delivery of which is not provided for by the contract, as well as the cargo, the name of which does not correspond to the name indicated in the railway bill of lading:
1) the consignee is obliged to notify the carrier in writing within 24 hours of receiving the notification of the arrival of the cargo that he is an improper party to the contract of carriage.;
2) the carrier is obliged to immediately notify the shipper of the need to dispose of the cargo, and the shipper is obliged to give a written instruction on the disposal of the cargo within four days (for perishable, dangerous goods - two days).
2. The consignee indicated in the consignment note has the right to receive the cargo upon payment of all payments due to the carrier.
3. If the instructions of the shipper on the disposal of the cargo are not received within the time limits provided for in paragraph 1 of this article, the carrier has the right to return the cargo to the shipper at his expense, and to dispose of the perishable cargo in accordance with paragraph 2 of Article 53 of this Law.
