Article 120. The right to targeted social assistance of the Social Code of the Republic of Kazakhstan

1. Targeted social assistance is provided to citizens of the Republic of Kazakhstan, Candace, refugees, foreign citizens, stateless persons permanently residing in the Republic of Kazakhstan, with an average per capita income not exceeding the poverty line.

     2. Individuals (families) have the right to targeted social assistance in the form of unconditional monetary assistance or conditional monetary assistance.

      3. The size of the poverty line in the Republic of Kazakhstan is determined by the authorized state body on the basis of the average subsistence level per capita in percentage terms, depending on the economic capabilities of the state.-Excluded by the Law of the Republic of Kazakhstan dated June 11, 2026 No. 306-VIII SAM. 

     4. The poverty line in the capital, regions, cities of republican significance, and the capital is calculated quarterly by local executive bodies based on the size of the poverty line determined by the authorized state body.-Excluded by the Law of the Republic of Kazakhstan dated June 11, 2026 No. 306-VIII SAM. 

     Information about:

     1) the poverty line – quarterly by local executive bodies;-Excluded by the Law of the Republic of Kazakhstan dated June 11, 2026 No. 306-VIII SAM. 

     2) the proportion of the population with incomes below the subsistence level in the republic, capital, regions, cities of republican significance – annually by the authorized body in the field of state statistics.-Excluded by the Law of the Republic of Kazakhstan dated June 11, 2026 No. 306-VIII SAM. 

     5. Targeted social assistance is assigned to each family member who has the right to receive it.

     Family members living together who are bound by property and personal non-property rights and obligations arising from marriage (matrimony), kinship, property, adoption or other form of adoption of children for upbringing, as well as cohabiting persons who are actually cohabiting but not married, are included in the family for targeted social assistance., except for persons who are:

     1) on full state support;

     2) in military service;

     3) in places of deprivation of liberty, on compulsory medical treatment.

     The fact of cohabitation is not required:

     1) persons or family members engaged in work outside the family's place of residence;

     2) children who live in a family and are registered in another locality at the place of study in secondary education organizations due to the absence of an educational organization of this level at the place of residence of the family;

     3) children studying in boarding schools, except those on full state support, as well as full-time students in technical and vocational, post-secondary, higher and (or) postgraduate education institutions of the Republic of Kazakhstan, after they reach the age of eighteen until the time of graduation from educational institutions (but not more than before reaching the age of twenty-three).

6. The determination of the amount, conditions of provision and criteria for concluding that there is no need to provide targeted social assistance are determined by the Government of the Republic of Kazakhstan.

     7. The procedure for the appointment and payment of targeted social assistance is approved by the authorized state body.

     8. The regulations on precinct commissions are developed and approved by the authorized state body.

     9. The rules for calculating the total income of a person (family) applying for targeted social assistance are developed and approved by the authorized state body.

     10. The poverty line in the capital, regions, and cities of national significance is calculated quarterly by local executive bodies based on the size of the poverty line determined by the authorized state body.
