Article 125. Criteria for concluding that there is no need to provide targeted social assistance to the Social Code of the Republic of Kazakhstan
1. The basis for the precinct election commission's conclusion that there is no need to provide targeted social assistance to the applicant and (or) persons meeting the requirements of paragraph 1 of Article 120 of this Code is one of the following criteria:
1) the presence of more than one dwelling belonging to him (them) by right of ownership, including a dwelling belonging to him (them) by right of ownership, which was alienated during the last five years prior to the application for targeted social assistance, except for the case when the total usable area of all dwellings is not exceeds eighteen square meters per family member, as well as dwellings in disrepair, which is confirmed by the relevant act.;
2) the presence in his (their) ownership, possession and (or) use of a separate room used for profit;
3) the existence in his (their) ownership of a land plot intended for individual housing construction, provided that he (they) own a dwelling, except in the case of gratuitous provision of a land plot to private ownership by a local executive body;
4) the presence in his (their) ownership of more than one car unit in a technically serviceable condition, with the exception of large families and families with children with disabilities, persons with disabilities of the first and second groups;
5) the presence in his (their) ownership and (or) temporary possession, use of agricultural machinery and (or) a bus, and (or) a minibus, and (or) a truck, and (or) a specialized and (or) a special car used for the transportation of passengers, baggage, cargo, or marine and (or) inland waterway, and (or) air transport, which are in technically sound condition.
The local executive body, in coordination with the local representative body, may establish additional grounds for concluding that targeted social assistance is necessary or not necessary, taking into account the specifics of the region and (or) the financial situation of the person (family).
2. Precinct commissions have the right to request information from the relevant authorities necessary for conducting surveys.
