Article 573. Handing over documents of the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. Upon request (instruction, petition) for the provision of legal assistance, the documents and decisions attached to this request (instruction, petition) shall be handed over to the person indicated in the request (instruction, petition) in accordance with the procedure established by this article.
2. The investigator, the body of inquiry, the prosecutor or the court, in order to execute a request (instruction, petition) for legal assistance, summon a person to serve documents. If a person fails to appear without valid reasons, a summons may be applied to him in accordance with the procedure provided for by this Code.
3. The investigator, the body of inquiry, the prosecutor or the court shall draw up a protocol on the delivery of documents to the person, indicating the place and date of their delivery. The protocol is signed by the person to whom the documents were handed, stating his statements or comments upon receipt of the documents. In cases stipulated by an international agreement of the Republic of Kazakhstan, a separate confirmation is also drawn up, which is signed by the person who received the documents and the person who delivered them.
4. If the person refuses to receive the documents to be served, this is indicated in the protocol. In this case, the documents to be served are considered to have been served, as indicated in the protocol.
5. If the documents to be served do not contain a translation into Kazakh or Russian and are written in a language that the person indicated in the request (instruction, petition) does not speak, such person has the right to refuse to receive the documents. In this case, the delivery of the documents is considered to have failed.
