Article 304. Presentation of the indictment of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. The prosecutor shall ensure that the indictment is handed over to the accused. The receipt of the indictment by the accused, containing an explanation of the rights of the accused, is attached to the case.

     2. In cases where the accused is located outside the Republic of Kazakhstan and evades appearing before the prosecutor's office, the prosecutor sends the indictment to the accused through available means of communication.

     If necessary, the prosecutor organizes the publication of a message about the referral of a criminal case to the court in the mass media, as well as publicly accessible telecommunications networks.

     3. A copy of the indictment shall be handed over to the defender of the accused, the victim and his legal representative, or sent to the specified persons through available means of communication.

     4. If the accused or the victim does not speak the chosen language of the judicial proceedings in which the pre-trial investigation was conducted, the indictment shall be served in the language he speaks.
