Article 72. The procedure for the execution of punishment in the form of deprivation of the right to hold a certain position or engage in certain activities of the Criminal Executive Code of the Republic of Kazakhstan
1. The court's verdict on a lifetime ban on holding teaching positions and positions related to work with minors is executed by organizations, regardless of their forms of ownership, in accordance with the procedure approved by the authorized body in the field of education.
2. The court's sentence of a lifetime ban on holding certain positions is executed by the administrations of state institutions and organizations specified in the Criminal Code of the Republic of Kazakhstan.
3. The organization of the execution of punishment in the form of deprivation of the right to hold certain positions or engage in certain activities, appointed as additional to arrest or imprisonment, is carried out by the institution or body executing the main punishment, and after serving the main punishments – by the probation service at the place of residence of the convicted person.
4. The organization of the execution of this punishment, imposed as an additional to other types of punishments, as well as in case of postponement of serving the sentence or suspended sentence, is carried out by the probation service at the place of residence of the convicted person.
5. Probation Service:
1) keeps records of convicted persons;
2) monitors the convicted person's compliance with the prohibition provided for by the court verdict to hold certain positions or engage in certain activities;
3) verifies the execution of the court's verdict by the administration of the organization at the convicted person's place of work, as well as by the authorities authorized to revoke permission to engage in the relevant type of activity prohibited to the convicted person;
4) in respect of convicted persons who have absconded in order to evade serving their sentence, carry out initial search measures and submit a wanted notice to the court.
6. A convicted person whose location has not been established for more than fifteen days from the date of his failure to appear for registration at the probation service is recognized as a fugitive from serving his sentence.
7. The administration of an institution or body executing a sentence in which a person sentenced to additional punishment in the form of deprivation of the right to hold certain positions or engage in certain activities is serving the main type of punishment may not involve him in work that is prohibited to him.
