Article 829-16. Announcement of the resolution on the results of consideration of the case of an administrative offense, on a complaint, protest against the decision on the case of an administrative offense, an order on the need to pay a fine, a decision of a higher authority (official) on the complaint, protest of the Code of the Republic of Kazakhstan On Administrative Offenses

 1. A court decision based on the results of consideration of an administrative offense case, on a complaint or protest against a decision on an administrative offense case, an order on the need to pay a fine, a decision of a higher authority (official) on the complaint or protest is announced immediately after its issuance.

1-1. After the announcement of the decision, the judge explains the legal consequences of its adoption, the procedure and time limits for appealing the decision and declares the court session closed.

2. A court decision shall be handed over or sent to the person against whom the decision on the case, complaint, or protest was issued, and to the victim, if he files a complaint or, at his request, to the prosecutor who brought the protest.

In the case of an administrative arrest order, the decision is immediately sent to the prosecutor.

3. A court decision on a complaint or protest against a decision on administrative arrest shall be brought to the attention of the body (official) executing the decision, as well as the person against whom it was issued, on the day of the decision.

4. In cases of administrative offences provided for in Articles 484 and 485 of this Code, in respect of a person to whom firearms and ammunition are entrusted in connection with the performance of official duties or transferred for temporary use by an organization, a copy of the resolution is sent to the relevant organization.

5. A court decision may be appealed or protested to a higher court in accordance with the procedure provided for in Chapter 45 of this Code.
