Thus, by the decision of the Baikonur district court of the city of Nur-Sultan dated June 18, 2018, upheld by the court of appeal, S.'s application for declaring illegal the de-registration of persons in need of housing from the state housing stock was satisfied. On January 25, 2006, S. was placed on the waiting list for housing in the category of "single-parent family".
By a decision of the housing commission dated December 23, 2016, S. and the children were removed from the queue, as they had a house registered jointly with the other two persons. The house is in a state of disrepair. Satisfying the applicant's claims, the court concluded that the applicant belonged to socially vulnerable segments of the population and needed housing. The house registered for the applicant cannot be recognized as a dwelling, since it does not meet technical and sanitary-epidemiological requirements, the useful area of the house is 32.8 sq.m., whereas at least 15 sq.m. is required for one person, that is, at least 45 sq.m. is required for the applicant and his family members.
