Article 12. Construction of nuclear installations and burial sites of the Law on the Use of Atomic Energy
1. The decision on the construction and construction area of nuclear installations and burial sites is made by the Government of the Republic of Kazakhstan with the consent of the local representative bodies on whose territory the installation or burial site is planned to be built, taking into account:
1) the need for them to solve the economic problems of the country and its individual regions;
2) availability of necessary conditions for the placement of the specified facilities that meet the requirements of the legislation of the Republic of Kazakhstan in the field of atomic energy use;
3) the absence of a threat to the safety of these facilities from nearby civilian and military facilities;
4) requirements established by the environmental legislation of the Republic of Kazakhstan;
5) possible social and economic consequences of the location of these facilities for the industrial, agricultural and social development of the region.
2. After the decision on the construction and the construction area is made, work is underway to select a nuclear installation site or a burial site.
3. The location of a nuclear installation or burial site should be determined taking into account:
1) possible external influences of a natural and (or) man-made nature;
2) possible transfer of radioactive substances;
3) the possibility of preventing damage to the public and the environment as a result of the operation of a nuclear installation or a burial site or as a result of incidents or accidents.
4. The design, construction and commissioning of a nuclear installation or burial site are carried out in accordance with this Law and other laws of the Republic of Kazakhstan.
5. Design documents for the construction, reconstruction, and decommissioning of nuclear installations and burial sites must undergo environmental and sanitary-epidemiological expertise.
6. The construction of nuclear installations and burial sites is allowed only to legal entities.
7. In cases of threat to national security, the Government of the Republic of Kazakhstan may decide to cancel the construction of a nuclear installation or a burial site.
8. The design, construction, operation and decommissioning of nuclear power plants are carried out only by the National Operator of nuclear Power plants and legal entities, more than fifty percent of the voting shares (participation shares in the authorized capital) of which directly or indirectly belong to the National Operator of nuclear Power plants.

This Law defines the legal basis and principles for regulating public relations in the field of the use of atomic energy in order to protect human life and health, their property, and environmental protection, and is aimed at ensuring the regime of non-proliferation of nuclear weapons, nuclear, radiation, and nuclear physical safety in the use of atomic energy.
