Article 2. Legislation of the Republic of Kazakhstan on the use of nuclear energy

   1. The legislation of the Republic of Kazakhstan in the field of atomic energy use is based on the Constitution of the Republic of Kazakhstan, consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

     2. If an international treaty ratified by the Republic of Kazakhstan establishes rules other than those contained in this Law, the rules of the international treaty shall apply.

    3. Legal relations regulated by the legislation of the Republic of Kazakhstan in the field of the use of atomic energy are not subject to the legislation of the Republic of Kazakhstan on public procurement regarding the purchase of goods, works and services for the implementation of projects in the field of peaceful uses of atomic energy by the National Operator of nuclear power plants, as well as legal entities with more than fifty percent of voting shares (participation shares in the authorized capital) which are directly or indirectly owned by the National Operator of the NPP.

     Purchases of goods, works and services for administrative, business, office, transport and other general purposes are carried out in accordance with the legislation of the Republic of Kazakhstan on public procurement.

This Law defines the legal basis and principles for regulating public relations in the field of the use of atomic energy in order to protect human life and health, their property, and environmental protection, and is aimed at ensuring the regime of non-proliferation of nuclear weapons, nuclear, radiation, and nuclear physical safety in the use of atomic energy.
