Article 22. Decommissioning of installations, early decommissioning of a nuclear or radiation installation and closure of a burial site of the Law on the Use of Atomic Energy
1. At the design stage of a nuclear installation or burial site, an operating organization shall develop a preliminary plan for decommissioning a nuclear installation or closing a burial site in accordance with the legislation of the Republic of Kazakhstan in the field of atomic energy use.
2. The preliminary decommissioning plan contains a description of the stages of decommissioning a nuclear installation or the closure of a burial site, methods of dismantling the main structures, estimates of the cost and timing of work, necessary resources, measures to ensure nuclear, radiation and nuclear physical safety, the basic norms and characteristics of the nuclear installation site after decommissioning or burial site after its closure.
3. When operating a nuclear installation or burial site, the preliminary decommissioning plan is subject to revision and modernization, taking into account new technical and technological developments, changes in nuclear, radiation and nuclear physical safety requirements, the cost of work and the required resources.
4. When making a decision on decommissioning a nuclear installation or closing a burial site, the operating organization draws up a final decommissioning plan, taking into account the technologies, techniques, economic indicators available at that time, and the requirements of the legislation of the Republic of Kazakhstan in the field of atomic energy use. The final decommissioning plan is the basis for designing and carrying out work on decommissioning a nuclear installation or closing a burial site.
5. The decision to discontinue the operation of the installation is made by the operating organization independently at any stage of the life cycle. At the same time, the operating organization notifies the authorized body of the decision taken, the start date and the timing of decommissioning work. The operating organization ensures that the work under the decommissioning plan is completed in full.
6. The decision on early decommissioning of a nuclear installation is made by the Government of the Republic of Kazakhstan upon presentation of the authorized body in case of violation of the requirements for safe operation of a nuclear installation, which led or could lead to a nuclear and (or) radiation accident, and the justified inability of the operating organization to ensure further safe operation of the nuclear installation.
7. The decision to close the burial site is made by the Government of the Republic of Kazakhstan upon the submission of the authorized body upon completion of measures to close it. The submission of the authorized body is based on the measures taken by the operating organization to close the burial site, including:
1) reclamation of the territory polluted as a result of the operation of the burial site;
2) carrying out control measurements of the radiation situation at the site of the burial site;
3) preparation of a package of documentation for transfer to the archive with a full description of the substances, materials, structure of the burial site, geotectonic, geological and geophysical characteristics of the site of the burial site.
The Law of the Republic of Kazakhstan dated January 12, 2016 No. 442-V SAM.
This Law defines the legal basis and principles for regulating public relations in the field of the use of atomic energy in order to protect human life and health, their property, and environmental protection, and is aimed at ensuring the regime of non-proliferation of nuclear weapons, nuclear, radiation, and nuclear physical safety in the use of atomic energy.
