Article 8. General conditions for carrying out activities in the field of the use of atomic energy of the Law on the Use of Atomic Energy

Article 8. General conditions for carrying out activities in the field of the use of atomic energy of the Law on the Use of Atomic Energy

     1. Individuals and legal entities engaged in activities related to the use of atomic energy are required to:

     1) have a license for the relevant type of activity in the field of atomic energy use;

     2) ensure the targeted management of nuclear energy facilities;

     3) ensure that the design and operational characteristics and parameters of an atomic energy facility comply with the requirements of nuclear, radiation and nuclear physical safety, control of specific goods and (or) the requirements of the nuclear non-proliferation regime;

     4) have an organizational structure and a system of internal documents ensuring compliance with the requirements of nuclear, radiation and nuclear physical safety established by the legislation of the Republic of Kazakhstan in the field of atomic energy use;

     5) have an organizational structure and a system of internal documents ensuring compliance with the requirements for accounting for nuclear materials in accordance with the legislation of the Republic of Kazakhstan in the field of atomic energy use;

     6) have an organizational structure and a system of internal documents ensuring compliance with the requirements for accounting for ionizing radiation sources in accordance with the legislation of the Republic of Kazakhstan in the field of atomic energy use;

     7) ensure accounting and control of nuclear materials and submit reports on their availability, movement and location to the authorized body;

     8) ensure accounting and control of ionizing radiation sources and submit reports on their presence, movement and location to the authorized body;

     9) inform the authorized body about any proposed changes in the systems, equipment, design and operational documentation of a nuclear installation related to ensuring nuclear, radiation or nuclear physical safety;

     10) inform the authorized body about accidents and incidents related to nuclear, radiation and nuclear physical safety;

     11) possess the necessary organizational, financial, logistical resources and have qualified personnel for the safe operation and maintenance of a nuclear installation throughout its life cycle;

     12) provide financial resources to ensure decommissioning of a nuclear installation, closure of a burial site, post-disposal, disposal of radioactive waste, elimination of consequences of radiation accidents, compensation for damage to human life and health, property of individuals and legal entities, as well as the environment;

     13) comply with the requirements of nuclear, radiation and nuclear physical safety established by the legislation of the Republic of Kazakhstan in the field of atomic energy use;

     14) keep records and analyze the radiation doses of workers admitted to nuclear and radiation-hazardous work while carrying out activities in the field of atomic energy use, and ensure the exercise of their rights to compensation;

     15) to provide training, professional development and timely certification of personnel employed at nuclear energy facilities.

     2. Individuals and legal entities operating facilities for the use of atomic energy and (or) owners of such facilities are not entitled to transfer facilities for the use of atomic energy to other individuals and legal entities if these persons do not have licenses for the relevant type of activity in the field of the use of atomic energy.

     3. Upon termination of their activities, individuals and legal entities dealing with nuclear energy facilities are required to carry out the following measures for the safe termination of their activities:

     1) transfer nuclear materials and (or) ionizing radiation sources to individuals and legal entities that handle nuclear energy facilities and have appropriate licenses to handle them;

     2) transfer radioactive waste and (or) spent radionuclide sources to storage or burial sites;

     3) transfer spent nuclear fuel to storage or burial sites or to legal entities handling nuclear energy facilities that have appropriate licenses for handling nuclear materials;

     4) to carry out work on environmental restoration, reclamation of the territory, decontamination of equipment and premises contaminated during the discontinued activities.

 

 

The Law of the Republic of Kazakhstan dated January 12, 2016 No. 442-V SAM. 

This Law defines the legal basis and principles for regulating public relations in the field of the use of atomic energy in order to protect human life and health, their property, and environmental protection, and is aimed at ensuring the regime of non-proliferation of nuclear weapons, nuclear, radiation, and nuclear physical safety in the use of atomic energy.
