Article 9. Licensing of activities in the field of the use of atomic energy of the Law on the Use of Atomic Energy
1. Licensing of activities in the field of atomic energy use is carried out in accordance with this Law and the legislation of the Republic of Kazakhstan on permits and notifications.
Licenses are issued for the following types of activities in the field of atomic energy use:
1) performance of works related to the stages of the life cycle of nuclear energy facilities;
2) Handling of nuclear materials;
3) handling of radioactive substances, devices and installations containing radioactive substances;
4) handling of devices and installations generating ionizing radiation;
5) provision of services in the field of atomic energy use;
6) Radioactive waste management;
7) transportation, including transit, of nuclear materials, radioactive substances, radioisotope sources of ionizing radiation, and radioactive waste within the territory of the Republic of Kazakhstan;
8) activities in the territories of former nuclear test sites and other territories contaminated as a result of nuclear tests.
A license is not issued for the following types of activities:
1) handling of nuclear materials below the withdrawal level;
2) handling of radioactive substances, devices and installations containing radioactive substances below the level of seizure;
3) handling of devices and installations generating ionizing radiation below the withdrawal level.
2. The deadline for consideration of the application for a license and (or) an appendix to the license for the types of activities specified in the sub-paragraphs 1), 2), 3), 4), 5), 6), 7) and 8) of the second part of paragraph 1 of this Article, is determined in accordance with the legislation of the Republic of Kazakhstan on permissions and notifications.
3. Excluded by the Law of the Republic of Kazakhstan dated 02/25/2021 No. 12-VII (effective from 01.01.2021).
4. The appendix to the license specifies the type of devices, installations, materials, substances, and waste that the licensee works with from the following list as special conditions for issuing a license:
1) installations for the production of nuclear fuel and its components;
2) nuclear power plants;
3) research nuclear (nuclear) reactors;
4) thermonuclear reactors;
5) installations for the extraction and processing of natural uranium;
6) storage facilities for highly radioactive waste;
7) medium-level radioactive waste storage facilities;
8) storage facilities for low-level radioactive waste;
9) spent nuclear fuel storage facilities;
10) storage facilities for radionuclide sources;
11) high-level radioactive waste disposal sites;
12) medium-level radioactive waste disposal sites;
13) low-level radioactive waste disposal sites;
14) spent nuclear fuel disposal sites;
15) disposal sites for spent radionuclide sources;
16) nuclear materials with indication of isotopic composition;
17) radioactive substances;
18) radiopharmaceuticals;
19) neutron generators;
20) uranium-containing substances;
21) thorium-containing substances;
22) natural uranium processing products;
23) closed radionuclide sources with activity indication;
24) highly active radioactive waste;
25) medium-level radioactive waste;
26) low-level radioactive waste;
27) radioisotope spectrometers, analyzers, sensors, meters;
28) X-ray spectrometers, analyzers, sensors, meters;
29) stationary radioisotope flaw detectors;
30) portable radioisotope flaw detectors;
31) stationary X-ray flaw detectors;
32) portable X-ray flaw detectors;
33) radioisotope installations for the inspection of hand luggage, baggage, transport, materials, substances;
34) X-ray equipment for the inspection of hand luggage, baggage, transport, materials, substances;
35) X-ray equipment for personal examination of a person;
36) electron accelerators with energy up to 10 MeV;
37) electron accelerators with energy above 10 MeV;
38) ion accelerators with energy up to 2 MeV/nucleon;
39) ion accelerators with energy above 2 MeV/nucleon;
40) medical particle accelerators;
41) general purpose medical X-ray machines;
42) medical X-ray dental equipment;
43) medical X-ray mammography units;
44) medical X-ray angiographic equipment;
45) medical computer X-ray tomographs;
46) medical radioisotope diagnostic equipment;
47) medical X-ray therapeutic equipment;
48) Medical X-ray simulators;
49) medical gamma-therapeutic installations.
4-1. The absence of the original documents during the verification of the applicant's compliance with the qualification or licensing requirements prior to the issuance of the permit and (or) the annex to the permit is the basis for refusal to issue the permit and (or) the annex to the permit.
5. A license for activities in the field of atomic energy use may be suspended for a period of no more than six months in the following cases::
1) in case of radiation accidents and (or) incidents;
2) in case of violation of the requirements of nuclear and (or) radiation and (or) nuclear physical safety, accounting of nuclear materials, sources of ionizing radiation, revealed as a result of verification;
3) if false information is found in the licensee's materials submitted upon receipt of the license;
4) in case of non-compliance with the instructions to eliminate violations of the requirements of the legislation of the Republic of Kazakhstan in the field of the use of atomic energy within the established time limits.
6. Upon suspension of the license, the licensee continues to ensure nuclear, radiation and nuclear physical safety.
7. Suspension or revocation of a license is carried out in accordance with the procedure established by the laws of the Republic of Kazakhstan.

This Law defines the legal basis and principles for regulating public relations in the field of the use of atomic energy in order to protect human life and health, their property, and environmental protection, and is aimed at ensuring the regime of non-proliferation of nuclear weapons, nuclear, radiation, and nuclear physical safety in the use of atomic energy.
