Article 217. Persons involved in the investigation of violations of the legislation of the Republic of Kazakhstan in the field of protection of competition of the Entrepreneurial Code of the Republic of Kazakhstan
1. The persons involved in the investigation of violations of the legislation of the Republic of Kazakhstan in the field of protection of competition are:
1) the applicant is a natural or legal person who has submitted information to the antimonopoly authority on violations of the legislation of the Republic of Kazakhstan in the field of competition protection;
2) the object of the investigation is an individual, a legal entity or its branch, which is an independent taxpayer (with the exception of financial organizations), in respect of whose actions the investigation is being conducted. These persons are recognized as the object of investigation from the moment the order to conduct an investigation is issued.;
3) interested persons – individuals or legal entities whose rights and legitimate interests are affected in connection with the consideration of a case on violation of the legislation of the Republic of Kazakhstan in the field of protection of competition;
4) an official of the antimonopoly authority is an employee of the antimonopoly authority authorized to conduct an investigation.;
5) witness – any natural person who may be aware of any circumstances relevant to the investigation;
6) an expert is an individual who is not interested in the case and has special scientific or practical knowledge.
2. During the investigation, the persons involved in the case have the right to exercise their rights and obligations independently or through a representative.
3. If during the investigation it is established that the signs of violation of the legislation of the Republic of Kazakhstan in the field of competition protection are contained in the action (inaction) of another person other than the object of investigation, the antimonopoly authority shall involve such person as the object of investigation in accordance with the procedure provided for in Article 216 of this Code.
