Article 223. Termination of investigation of violations of the legislation of the Republic of Kazakhstan in the field of protection of competition of the Entrepreneurial Code of the Republic of Kazakhstan
The Antimonopoly Authority shall terminate the investigation of violations of the legislation of the Republic of Kazakhstan in the field of competition protection in the following cases::
1) the absence of violations of the legislation of the Republic of Kazakhstan in the field of competition protection in the actions of the object of investigation;
2) liquidation of a legal entity – the only object of investigation;
2-1) de–registration of a branch of a legal entity, the only object of investigation;
3) death of an individual – the only object of investigation;
4) expiration of the limitation period established by the Code of the Republic of Kazakhstan on Administrative Offenses;
5) the existence of a judicial act that has entered into legal force, which contains conclusions on the presence or absence of violations of the legislation of the Republic of Kazakhstan in the field of competition protection in the actions (inaction) considered by the antimonopoly authority.
