Article 259. Elimination of the consequences of the use of subsurface space Code on Subsurface and Subsurface Use Republic of Kazakhstan
1. The elimination of the consequences of operations involving the use of subsurface space, with the exception of the consequences provided for in Article 260 of this Code, shall be carried out through the reclamation of disturbed lands in accordance with the Land Code of the Republic of Kazakhstan.
2. A person whose right of subsurface use has been terminated in the relevant subsurface area is obliged to proceed to liquidation no later than eight months from the date of such termination. Man-made mineral formations located on the territory of a subsurface area as a result of mining or mining processing production are recognized as included in the subsurface as their resources from the date of termination of the license and are subject to liquidation in accordance with this article.
3. The elimination of consequences on a part of the subsurface area that the subsurface user has abandoned in accordance with the provisions of Article 261 of this Code shall be carried out before such abandonment. The use of such a part of the site during the period after the completion of liquidation and before its exclusion from the license for the use of subsurface space is not allowed.
4. The liquidation of the consequences of operations involving the use of subsurface space in the subsurface use area (part of it) is considered completed from the date of signing the liquidation act. The liquidation act is signed by a commission established by the relevant local executive body of the region, city of republican significance or capital from among its representatives and representatives of authorized state bodies for the study of subsurface resources, in the field of environmental protection, industrial safety, the state body in the field of sanitary and epidemiological welfare of the population, and the subsoil user (the person whose right of subsurface use has been terminated, if available). If liquidation is carried out on a land plot that is privately owned, permanent or long-term temporary paid land use, the liquidation act is also signed by the owner of the land plot or the land user.
5. The completion of the liquidation of the consequences of operations involving the use of subsurface space is the basis for entering relevant information into the unified cadastre of the state subsurface fund.
