Article 30. Liquidation of the legal entity of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse

Article 30. Liquidation of the legal entity of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse  

     1. If information is established about the facts of illicit trafficking in narcotic drugs, psychotropic substances, their analogues, and precursors in an organization providing services in places of mass residence of citizens, such an organization is subject to liquidation by a court decision, and the perpetrators are held accountable in accordance with the laws of the Republic of Kazakhstan.  

     2. If it is established that a legal entity has carried out a financial transaction for the purpose of legalizing (laundering) income received as a result of illicit trafficking in narcotic drugs, psychotropic substances, their analogues and precursors, the specified legal entity may be liquidated by a court decision, and its managers are responsible in accordance with the laws of the Republic of Kazakhstan.  

      3. State bodies authorized to carry out counteraction to illicit trafficking of narcotic drugs, psychotropic substances, their analogues and precursors, have the right to file a claim with the court for liquidation of a legal entity in the cases provided for in paragraphs 1 and 2 of this Article, in accordance with the procedure established by the legislation of the Republic of Kazakhstan.  

 

 

The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.

     This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
