Article 273-1. Elimination of consequences of prospecting Code on Subsoil and Subsoil Use Republic of Kazakhstan
1. Elimination of consequences of prospecting is carried out by reclamation of the disturbed lands in accordance with the Land Code of the Republic of Kazakhstan.
2. A person whose right of subsurface use has been terminated in a mining area is obliged to complete the liquidation of the consequences of mining in such area no later than six months after the termination of the mining license.
At the request of the said person, the local executive body of the region extends the period for the elimination of the consequences of prospecting for a period of up to four months from the date of expiry of the period provided for in part one of this paragraph, if the liquidation was impossible or significantly hampered by weather and (or) climatic conditions.
3. The liquidation of the consequences of prospecting on a part of the mining site that the subsurface user refused before the expiration of the prospecting license in accordance with Article 275 of this Code, shall be carried out before such refusal.
4. If the subsurface user has not carried out prospecting on the mining site (part of it), which the subsurface user has abandoned, liquidation work on such mining site (part of it) is not required.
In this case, an act of inspection of the mining site (part of it) is drawn up, confirming the absence of the need for liquidation work, which is signed by the persons specified in paragraph 5 of this article.
5. The liquidation of the consequences of operations at the mining site (part of it) is considered completed after the signing of the liquidation act. The act of liquidation is signed by a commission established by the relevant local executive body of the region from its representatives and representatives of the authorized body in the field of environmental protection, and the subsoil user (the person whose right of subsurface use has been terminated, if any). If liquidation is carried out on a land plot that is privately owned, permanent or long-term temporary paid land use, the liquidation act is also signed by the owner of the land plot or the land user.
6. The signing of the act of liquidation of the consequences of prospecting is the basis for entering relevant information into the unified cadastre of the state subsoil fund in order to subsequently grant the right of subsurface use for prospecting to other persons.
