Article 309. Functions of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan of the Entrepreneurial Code of the Republic of Kazakhstan
Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan in order to represent, ensure and protect the rights and legitimate interests of business entities, as well as to protect the interests of the business community:
1) represents, ensures, protects the rights and legitimate interests of business entities in state bodies and other organizations of the Republic of Kazakhstan, as well as international organizations and foreign states;
2) considers the appeals of business entities;
3) submits proposals to state bodies on the protection of the rights of business entities, as well as recommendations on the suspension of subordinate regulatory legal acts;
3-1) submits proposals to the authorized business body for the cancellation or revision of existing regulatory instruments and (or) requirements for complaints from business entities in accordance with paragraph 3 of Article 82 of this Code.;
4) sends recommendations to government agencies (officials) whose actions (inaction) violated the rights and legitimate interests of business entities on measures to restore violated rights, including bringing those responsible for violating the rights and legitimate interests of business entities to justice.;
5) submits petitions to the prosecutor's office in case of disagreement with the opinion of state bodies in order to further restore the violated rights of entrepreneurs.;
6) submits appeals to the President of the Republic of Kazakhstan in case of systemic violations of the rights of entrepreneurs and the impossibility of their resolution at the level of state bodies.;
7) requests information, documents and materials from government agencies (officials) concerning the rights and obligations of business entities, with the exception of information constituting state, commercial, banking and other legally protected secrets.;
8) applies to the court with a claim (application) in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
9) takes other legal measures aimed at restoring the violated rights and legitimate interests of business entities.
