Article 311. Procedure for consideration of appeals by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan of the Entrepreneurial Code of the Republic of Kazakhstan  

     1. The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan within the limits of his competence:

     1) considers the appeals of business entities (hereinafter referred to as the applicant), with the exception of appeals:

     which have not previously been reviewed by government agencies within their competence;

     on the facts of violation of the applicant's rights by other private business entities;

     2) informs applicants about the direction of their appeals to authorized state bodies and organizations.;

     3) informs the applicants about the results of the consideration of their appeals and the measures taken.

     2. The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan shall, within ten calendar days, review applicants' appeals for compliance with the requirements set out in subparagraph 1) of paragraph 1 of this article, in case of non-compliance with which he leaves the appeal without consideration, and notifies the applicant in writing.

     3. Applicants' appeals received by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan are considered within thirty calendar days.

     4. If necessary, the deadline for consideration of appeals received by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan is extended with mandatory notification of the applicant about the work being done.

     5. Based on the results of the review, the applicant is provided with an answer on the merits of the appeal within the competence of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan.

     6. The procedure for extending the time limits for consideration of appeals, sending them to authorized state bodies and organizations, and informing applicants about the progress of consideration of appeals shall be established by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan.
