Article 43. Appeal against actions (inaction) and acts of the Prosecutor of the Constitutional Law on the Prosecutor's Office

     1. Actions (inaction) and acts of a prosecutor may be appealed to a higher prosecutor or to a court in cases and in accordance with the procedure established by this Constitutional Law and other laws of the Republic of Kazakhstan.

     2. The appeal against the acts and actions of the prosecutor does not suspend their execution.

     The court or a higher prosecutor has the right to suspend their execution until a decision is made on a complaint against the prosecutor's acts or actions.

     3. Upon a complaint from individuals and (or) legal entities, or on its own initiative, a higher prosecutor may revoke, revoke, suspend or amend acts of a lower prosecutor.

     4. Appeals against decisions, actions (inaction) and acts of the Office of the Prosecutor's Office for the return of assets and its officials are carried out in accordance with the Law of the Republic of Kazakhstan "On the return of illegally acquired assets to the State".

     This Constitutional Law defines the competence, organization and procedure of the Prosecutor's Office of the Republic of Kazakhstan.
