Article 66. Termination of the activity of the Housing and Construction Cooperative of the Housing Relations Act

     1. The completion of the construction of an apartment building is formalized by an act of acceptance of the facility in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.

     The act of acceptance of an object into operation is the basis for entering into the information system of the legal cadastre identification and technical information about the object and (or) its components for newly created immovable property, registration of rights to immovable property.

     2. After registration of the certificate of acceptance of the facility into operation and registration of ownership rights of the first owner of the apartment, non-residential premises, the executive body of the housing and construction cooperative ensures registration of the condominium facility within one month.

     3. Members of a housing and construction cooperative are required to register ownership of apartments and non-residential premises in accordance with the procedure established for the registration of real estate.

     4. The right to demand the elimination of deficiencies in the construction of an apartment building identified within the warranty period arises from a housing and construction cooperative, the owner of an apartment, non-residential premises, parking space, storage room, association of property owners, the entity managing the condominium facility.  

     This provision should be provided for in the construction contract between the housing and construction cooperative and the contractor.

     5. The housing and construction cooperative ceases its activities after fulfilling all its obligations in accordance with the legislation of the Republic of Kazakhstan.
