Article 833. Assessment of insurance risk and damage caused by the Civil Code of the Republic of Kazakhstan
1. When concluding a property insurance contract, the insurer has the right to inspect and evaluate the insured property, and, if necessary, appoint an expert examination in order to determine its actual value.
The assessment of the insured property and the damage caused by the insurer is an integral part of the insurance and does not require additional licensing.
2. When concluding a personal insurance contract, the insurer has the right to conduct an examination of the insured person to assess the actual state of his health.
3. The assessment of insurance risk by the insurer on the basis of this article is optional for the policyholder, who has the right to prove otherwise.
4. The amount of damage caused as a result of the occurrence of an insured event is determined by the insurer at the request of the policyholder or his representative. If necessary, an assessment of the amount of damage caused is carried out by an appraiser (independent expert). In case of disagreement with the results of the assessment of the damage caused, the parties have the right to prove otherwise.
5. In case of compulsory insurance, the procedure and conditions for assessing the amount of damage caused as a result of the occurrence of an insured event may be established by legislative acts of the Republic of Kazakhstan.
